1.2 How to read this agreement

Headings exist for convenience and do not affect interpretation. Singular words include the plural and the reverse. A reference to a statute includes any amendment or replacement of it. The word "including" means "including without limitation." Plain English summaries appear throughout in shaded boxes. Those summaries help you understand the section. The section text itself controls if the two ever conflict.

Service description

In short

We give you a real Massachusetts street address, receive your mail and packages there, and send them wherever you are.

2.1 Overview

MyMailForwarder.com operates as a USPS-approved Commercial Mail Receiving Agency, serving customers in more than 220 countries and territories. We have been receiving and forwarding mail from Massachusetts since 2007. The Services include:

  • A permanent U.S. street address with a dedicated suite number. This is a commercial street address and not a P.O. Box.
  • Receiving and holding of letter mail and packages
  • Digital mail scanning and email notification
  • Domestic and international mail forwarding
  • Free package consolidation on Silver and Gold plans
  • Personal Concierge purchasing from U.S. retailers on your behalf
  • Secure storage within the limits of your Subscription Plan
  • Massachusetts registered agent service under M.G.L. Chapters 156C and 156D, where you subscribe to it as a separate add-on

Compare what each plan includes on our U.S. mailbox plans and pricing page.

2.2 CMRA authorization

The Company holds authorization from the United States Postal Service as a Commercial Mail Receiving Agency and operates in compliance with 39 CFR § 3001 and applicable USPS regulations. This authorization allows us to receive mail and packages on your behalf once you complete USPS Form 1583. Every employee who handles customer mail has passed a background check.

2.3 Service availability

We provide the Services subject to availability and our operational capacity. We reserve the right to refuse service, limit quantities, decline a specific shipment or modify our service offerings at any time without prior notice. We are not a common carrier and we do not guarantee carrier transit times.

Eligibility and account registration

In short

You need to be 18 or older, give us accurate identity details and keep your login secure.

3.1 Age and capacity

The Services are available to individuals aged 18 or older who are legally able to enter a binding contract, and to entities properly registered in their home jurisdiction. By registering, you confirm you meet these requirements.

3.2 Accurate information

You agree to give complete and accurate registration information and to keep it current. This includes your legal name, your permanent physical residential address, your telephone number and your email address. Federal CMRA rules require a verified permanent physical address. A P.O. Box does not satisfy this requirement.

3.3 Identity verification

We verify the identity of every applicant. You agree to supply two valid forms of identification, at least one of which carries a photograph and a traceable address. We reserve the right to request additional documentation, to re-verify your identity at any point during your subscription and to suspend service until verification is complete.

3.4 Account security

You are responsible for every activity under your Account and for keeping your password confidential. Notify us through our contact page as soon as you suspect unauthorized access. We are not liable for losses arising from your failure to protect your credentials.

3.5 One account per customer

Each individual or entity is entitled to one Account unless we approve additional accounts in writing. Named recipients added to your mailbox each require their own USPS Form 1583 authorization and identity documents. Minors listed as recipients must live at the same permanent address as the account holder.

USPS Form 1583 and CMRA requirements

Federal requirement

USPS Form 1583 is mandatory under 39 CFR § 3001.10. We are not permitted to accept mail or packages on your behalf without a properly completed and notarized form on file.

4.1 Mandatory completion

Federal law requires every customer to complete USPS Form 1583, the Application for Delivery of Mail Through Agent, before we accept mail on their behalf. This requirement is not negotiable and we have no authority to waive it. Our Form 1583 walkthrough takes you through it step by step.

4.2 Form requirements

Your Form 1583 must be:

  • Completed in full with accurate information
  • Signed in the presence of a notary public or an authorized USPS employee
  • Accompanied by two valid forms of identification
  • Submitted to us within 7 days of account creation

4.3 Notarization assistance

We offer notarization assistance at no extra charge through in-person notarization at our Massachusetts facility by appointment, remote online notarization by video conference, or a referral to a notary in your area.

4.4 Consequences of an incomplete form

Mail arriving before we hold a valid Form 1583 will be returned to sender or refused. We are not liable for mail returned, delayed or lost during a period when your form is missing, expired or incomplete. Your subscription fees continue to accrue during that period.

4.5 Changes to your information

Notify us within 30 days of any change to your permanent address, legal name or authorized recipients. A new Form 1583 is required for each added recipient and after any legal name change.

Billing, fees and payment

In short

Subscriptions renew automatically until you cancel. Shipping and add-on charges are billed separately as they are incurred.

5.1 Subscription fees

Subscription fees are billed in advance for the term you select at checkout. Annual plans include one bonus month, which means 13 months of service for the price of 12. Flexible 3-month and 6-month terms are also available. Current pricing appears on our pricing page and is quoted in U.S. dollars.

5.2 Automatic renewal

Your subscription renews automatically at the end of each term at the rate then in effect, until you cancel. You authorize us to charge your payment method on file for each renewal. Cancel at any time through your account dashboard or our contact page before your renewal date to stop the next charge.

5.3 Shipping, handling and ancillary charges

Forwarding costs, carrier surcharges, customs brokerage, consolidation handling outside your plan, scanning volume above your plan allowance, storage above your plan window, special handling and Concierge purchase costs are billed separately from your subscription. We charge these to your payment method on file or require prepayment before we release a shipment.

5.4 Taxes and duties

Prices exclude taxes. You are responsible for all import duties, customs charges, VAT, GST and any levy imposed by your destination country. Carriers collect these at delivery. We have no control over them and we do not refund them. Our customs and duties guide explains what to expect.

5.5 Failed payments

If a charge is declined, we will attempt to notify you and retry the payment. Accounts more than 15 days past due are suspended, which means we stop accepting and forwarding mail. Accounts more than 60 days past due are subject to termination and disposal of held mail under Section 9.

5.6 Chargebacks

Contact us before disputing a charge with your bank. A chargeback filed without first raising the issue with us will result in immediate account suspension. You remain responsible for the disputed amount together with any bank fee we incur.

5.7 Price changes

We reserve the right to change subscription pricing. We will give you at least 30 days notice by email before a price change applies to your renewal. Continuing your subscription after the effective date is your acceptance of the new price.

Refunds and cancellations

Non-refundable policy

All subscription payments are final and non-refundable except where our Refund and Returns Policy expressly provides otherwise.

6.1 Refund and Returns Policy incorporated

Our Refund and Returns Policy forms part of this agreement and is incorporated by reference. It sets out the full detail of what qualifies for a refund, what does not and how to request one. Read it before you subscribe.

6.2 Cancelling your subscription

You are free to cancel at any time. Cancellation stops future renewals. It does not refund the current term. Your mailbox stays active until the end of the paid term, after which we stop accepting mail addressed to you. Arrange forwarding of any held mail before your term ends.

6.3 Charges never refunded

  • Postage and carrier shipping charges once a label is purchased
  • Customs duties, import taxes and brokerage fees
  • Storage fees already incurred
  • Scanning, special handling and Concierge service fees for work already performed
  • Any charge on an account terminated for cause under Section 18

6.4 Carrier loss and damage

Loss or damage in carrier transit is a claim against the carrier and not against MyMailForwarder.com. We will supply tracking records, weights, photographs and documentation to support your claim. Section 16 governs our own liability.

6.5 Service failure on our part

Where a verified and documented failure by us prevents you from receiving the Services you paid for, we will refund the unused portion of your subscription term as described in our Refund and Returns Policy.

Plan features and service limits

In short

Each plan carries its own allowances for recipients, scanning and storage. Go over the allowance and we bill the overage.

7.1 Plan allowances

Your Subscription Plan sets the number of authorized recipients, the scanning allowance, the included storage volume and the free storage period. Current allowances for the Starter Plan, Silver Plan and Gold Plan appear on our plans and pricing page and form part of this agreement.

FeatureHow it works
Package consolidationIncluded free on Silver and Gold plans. We combine multiple inbound packages into one outbound shipment on request.
Digital mail scanningFree email notification on every arrival. Contents scanning to PDF on request, within your plan allowance.
StorageFree for 30 days on Starter, 60 days on Silver and 90 days on Gold. Storage fees apply after your plan window.
ForwardingOn demand at discounted USPS, FedEx and UPS rates. You choose the carrier and service level for each request.
Personal ConciergeWe purchase from U.S. retailers on your behalf where the retailer blocks international billing. Purchase cost plus service fee is payable in advance.

7.2 Overage charges

Usage above your plan allowance is billed at the rates published on our pricing page. We will notify you before a large overage where practical. Upgrading your plan at any point in the term is a straightforward change through our contact page.

7.3 Fair use

Plans are designed for normal personal and business mail volumes. Commercial reshipping operations, drop shipping fulfilment and freight volumes require a written agreement with us in advance. We reserve the right to reclassify an account whose volume is inconsistent with its plan and to bill the correct rate.

7.4 Turnaround targets

We aim to log inbound items within one Business Day of receipt and to process forwarding requests within one to two Business Days. These are operational targets and not contractual guarantees. Peak periods, carrier disruption and holidays affect turnaround.

Mail and package handling

In short

We log what arrives, hold it, and act on your instructions. Tell us what to do and we do it.

8.1 Receipt and notification

We log each item on arrival and notify you by email at no charge. Notification includes the sender where visible, the item type and, for packages, the carrier and tracking number. Log in to your dashboard to view your inventory and issue instructions.

8.2 Your instructions

We act on the instructions in your account. Your options for each item are forward, scan, hold, consolidate, return to sender, recycle or shred. Where you give no instruction, we hold the item under Section 9 until your free storage period ends.

8.3 Consolidation and repackaging

Consolidation combines multiple packages into a single outbound shipment and typically cuts international shipping costs by 30 to 40 percent per batch. Repackaging involves removing original retail boxes, excess packaging and promotional inserts to lower dimensional weight. Repackaging affects manufacturer warranty claims and retailer returns in some cases. You accept that risk when you request it.

8.4 Address accuracy

You are responsible for the accuracy of the destination address you supply. Address correction surcharges, redelivery fees and reshipping costs arising from an incorrect address are billed to you.

8.5 Undeliverable and returned shipments

Where a carrier returns a shipment as undeliverable, we return it to your mailbox and notify you. Storage fees resume on the return date. You are responsible for the original outbound postage together with any return charge levied by the carrier.

8.6 Mail addressed to unauthorized recipients

Federal CMRA rules prohibit us from accepting mail for any person not listed on your Form 1583. We return such items to sender. Repeated receipt of mail for unauthorized recipients is grounds for termination under Section 18.

8.7 High value items

Declare the value of inbound and outbound items accurately. Carrier declared value coverage is available at additional cost and you must request it before we ship. Our own liability remains limited under Section 16 whether or not you purchase carrier coverage.

Storage, abandoned mail and disposal

Do not leave mail unattended

Mail left without instructions past the periods below is treated as abandoned and disposed of. Recovery is not possible once disposal has taken place.

9.1 Free storage period

Each plan includes a free storage window: 30 days on Starter, 60 days on Silver and 90 days on Gold, with up to 5 cubic feet of capacity at the Gold level. Storage fees apply once your window ends. Storage fees accrue per item and are billed to your payment method on file.

9.2 Abandonment

An item is treated as abandoned where any of the following applies:

  • It has been held for 90 days past the end of your free storage window with no instruction from you
  • Your account has been suspended for non-payment for 60 days
  • Your subscription has ended and you have not arranged forwarding within 30 days
  • Accrued storage fees on the item exceed its declared value

9.3 Disposal

We reserve the right to shred, recycle, donate or otherwise dispose of abandoned items without further notice and without liability. Where an item carries obvious resale value, we reserve the right to sell it and apply the proceeds against your outstanding balance. Any surplus is returned to you on request within 12 months.

9.4 Perishables and hazards

We refuse or immediately dispose of perishable goods, live plants, live animals and any item leaking, emitting odor or presenting a safety hazard. No refund or compensation applies.

9.5 Facility security

Our Tewksbury facility is monitored and access is restricted to background-checked staff. We take reasonable care of items in our custody. We are not an insurer and we are not a bailee for hire beyond the liability limit in Section 16.

Export controls and international compliance

In short

You are the exporter of record. U.S. export law applies to everything we ship for you.

10.1 You are the exporter of record

For every international shipment, you act as the exporter of record. You are responsible for compliance with the Export Administration Regulations, the International Traffic in Arms Regulations, the sanctions programs administered by the Office of Foreign Assets Control and every applicable U.S. and destination country law.

10.2 Sanctioned destinations and parties

We do not forward to countries or regions under comprehensive U.S. sanctions. We do not provide Services to any person or entity on the Specially Designated Nationals list, the Denied Persons list, the Entity List or any comparable restricted party list. We screen accounts and destinations against these lists.

10.3 Controlled goods

Items subject to export licensing, including defense articles, encryption hardware above license thresholds, dual use technology and controlled technical data, require a valid license issued to you before we ship. Provide the license documentation in advance. We are not export consultants and we do not classify your goods for you.

10.4 Customs declarations

You supply the contents description, the declared value and, where required, the harmonized tariff code for each shipment. Under-declaring value to avoid duty is fraud. We refuse any shipment where the declaration appears inaccurate and we report suspected violations to the appropriate authorities.

10.5 Destination country restrictions

Every country restricts different imports. Verify what your destination allows before you ship. Seizure, destruction or fines imposed by a destination customs authority are your responsibility and no refund applies.

Prohibited items and restricted shipments

Strictly prohibited

We will not accept the items below under any circumstances. Sending them to your mailbox results in immediate account termination, disposal of the item without compensation and a report to the appropriate authorities.

11.1 Absolute prohibitions

Hazardous materials

Explosives, flammable liquids and solids, oxidizers, toxic substances, radioactive materials, corrosives and compressed gases.

Weapons and ammunition

Firearms, gun parts and accessories, ammunition, knives other than culinary, martial arts weapons, tasers, stun guns and pepper spray.

Controlled substances

Illegal drugs, drug paraphernalia, prescription medication without proper licensing, marijuana and CBD products.

Currency and negotiables

Cash, checks, money orders, bank drafts, bearer bonds and stock certificates.

Counterfeit goods

Knock-offs, replicas and any item infringing a trademark, copyright or other intellectual property right.

Tobacco and vaping

Cigarettes, cigars, loose tobacco, e-cigarettes, vaping devices and e-liquids.

Living and perishable goods

Live animals, live plants, human remains, biological specimens and food requiring refrigeration.

Illegal and obscene material

Any item whose possession, sale or transport is unlawful in the United States or in the destination country.

11.2 Restricted items requiring prior approval

Lithium batteries

Loose batteries are prohibited. Batteries installed in a device are accepted subject to carrier rules and correct labeling.

Alcohol

Accepted only where the destination country permits it, the carrier accepts it and you have arranged licensing in advance.

Aerosols and cosmetics

Pressurized containers, nail polish, perfume and similar goods are subject to carrier hazardous material rules.

High value goods

Jewelry, precious metals and items above 2,500 USD in declared value require written approval and additional coverage.

11.3 Ongoing responsibility

Carrier and government restriction lists change. Check current USPS, FedEx and UPS restrictions together with the import rules of your destination country before each shipment. The list above is not exhaustive and we reserve the right to refuse any item at our discretion.

11.4 Consequences

Where a prohibited item arrives at our facility, we refuse it, dispose of it, surrender it to law enforcement or return it to sender at our discretion. You are responsible for all resulting costs, fines and penalties. No refund applies and Section 17 indemnification is triggered.

Inspection rights

In short

We open packages when law, safety or a customs form requires it. We never open sealed first class letter mail without your instruction.

12.1 Package inspection

You authorize us to open and inspect any package addressed to you where inspection is needed to complete a customs declaration, verify contents against a declared value, confirm compliance with Section 11, investigate a suspected hazard or comply with a law enforcement request.

12.2 Letter mail

Sealed first class letter mail carries federal protection. We open and scan the contents of letter mail only where you instruct us to do so through your account, or where a court order or lawful government demand requires it.

12.3 Law enforcement and regulatory access

We cooperate with lawful requests from USPS Postal Inspectors, Customs and Border Protection, Homeland Security Investigations and other authorized agencies. Where the law permits us to notify you of such a request, we will. Some demands prohibit notification.

12.4 Documentation

We photograph items during inspection and retain those records as part of your account history. Our Privacy Policy governs how we store and share those records.

Your responsibilities

13.1 Lawful use

Use the Services only for lawful purposes. You agree not to use your U.S. address or the Services to commit fraud, launder money, evade tax, evade sanctions, distribute counterfeit goods, harass any person or conceal a criminal enterprise.

13.2 Accurate representation of your address

Your mailbox address is a real commercial street address with a suite number. Present it accurately, including the suite designation, on business registrations, bank applications and government filings. Removing or altering the suite number to disguise the nature of the address violates this agreement and USPS rules.

13.3 Business use and registered agent service

Using the address for LLC formation, IRS correspondence and business banking is permitted. Massachusetts registered agent service under M.G.L. Chapters 156C and 156D is a separate add-on. Subscribe to it through our registered agent service page before naming us as your registered agent in any state filing.

13.4 Monitoring your account

Check your dashboard and email notifications regularly. Respond to inbound item notifications within your free storage window. Keep your payment method valid and your contact details current.

13.5 Third party sellers

Retailer return windows, warranty terms and refund policies belong to the retailer. Our receipt of an item at your mailbox does not extend any retailer deadline. Track your own return windows.

Intellectual property

14.1 Our content

The MyMailForwarder.com name, logo, website design, text, graphics, photographs, software and compiled content are owned by Biz International Corp. or licensed to it, and are protected by United States and international copyright and trademark law.

14.2 Restrictions

You agree not to copy, reproduce, republish, scrape, distribute or create derivative works from our content without our prior written consent. Automated scraping of our pricing pages, blog articles or account interfaces is prohibited.

14.3 Limited license to you

We grant you a personal, non-transferable, revocable license to access the website and use the Services for their intended purpose during your subscription term.

14.4 Feedback

Suggestions and feedback you send us are non-confidential. We are free to use them without obligation or compensation to you.

14.5 Copyright complaints

Send notices of claimed copyright infringement to our legal contact in Section 23 with the information required by the Digital Millennium Copyright Act.

Privacy and data protection

In short

We collect what federal CMRA rules require and what running your mailbox needs. We do not sell your data.

15.1 Privacy Policy incorporated

Our Privacy Policy forms part of this agreement and explains what we collect, why we collect it, how long we keep it and who we share it with. It addresses GDPR and CCPA rights.

15.2 Required record keeping

Federal CMRA rules require us to retain your Form 1583, your identity documents and your mail delivery records. We retain these for the period USPS regulations specify, which extends beyond the end of your subscription.

15.3 Mail images

Scanned envelope exteriors and requested content scans are stored in your account. Deleted scans are removed from active systems within 30 days. Backup copies age out on our standard backup cycle.

15.4 Service providers

We share limited data with payment processors, shipping carriers, customs authorities and identity verification providers, in each case only as far as delivering the Services requires. We do not sell personal data.

15.5 International transfers

Operating an international forwarding service involves transferring your data to carriers and customs authorities outside the United States. Using the Services is your consent to those transfers.

Limitation of liability

Important limitation

This section significantly limits what we owe you if something goes wrong. Read it carefully.

16.1 Services provided as is

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE.

16.2 Excluded damages

THE COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR REPUTATIONAL HARM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16.3 Liability cap

THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT OR THE SERVICES SHALL NOT EXCEED THE LESSER OF:

  • The total fees you paid to us in the 12 months preceding the claim, OR
  • 500 USD

16.4 Carrier acts

Once a shipment leaves our facility with a carrier, the carrier's terms and liability limits govern it. Claims for loss, delay or damage in transit lie against the carrier. We assist with documentation and we do not assume carrier liability.

16.5 Statutory rights

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that applies to you, the limitations above apply only to the extent your local law permits, and nothing in this agreement removes a right you hold that cannot be waived by contract.

16.6 Time limit on claims

Bring any claim arising from this agreement or the Services within one year of the event giving rise to it. Claims brought after one year are permanently barred, except where applicable law forbids that limit.

Indemnification

17.1 Your indemnity

You agree to defend, indemnify and hold harmless Biz International Corp., its officers, directors, employees, agents and affiliates from any claim, demand, loss, fine, penalty, liability, cost or expense, including reasonable attorney fees, arising from:

  • Your use or misuse of the Services
  • Your breach of this agreement or of any policy incorporated into it
  • Your violation of any law, regulation or export control rule
  • Any item you send to or through our facility, including prohibited items
  • Any inaccurate customs declaration, address or identity information you supply
  • Any claim by a third party relating to goods you purchased, received or forwarded

17.2 Survival

This indemnity survives the termination of your account and continues for as long as the underlying claim remains actionable.

17.3 Our control of defense

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense.

Suspension and termination

18.1 Termination by you

Cancel at any time through your dashboard or our contact page. Arrange forwarding of held mail before your paid term ends. Section 6 governs refunds.

18.2 Suspension by us

We reserve the right to suspend your account immediately where payment fails, identity verification lapses, a prohibited item arrives, we receive a law enforcement request or we reasonably suspect fraudulent or unlawful use. Suspension stops acceptance and forwarding of your mail. Subscription fees continue to accrue during suspension.

18.3 Termination for cause

We reserve the right to terminate your account without refund for a material breach of this agreement, for repeated violations of Section 11, for use of the address to commit fraud, for chargeback abuse or for abusive conduct toward our staff.

18.4 Termination without cause

We reserve the right to end a subscription without cause on 30 days written notice. Where we do so, we refund the unused portion of your prepaid term and give you 30 days to arrange forwarding of held mail.

18.5 Effect of termination

On termination we stop accepting mail addressed to you and return further inbound items to sender. Held mail is subject to Section 9. Your access to scans and account history ends. Request an export of your records before your account closes.

18.6 Surviving sections

Sections 9, 14, 15, 16, 17, 20, 21 and 22 survive termination.

Force majeure

Neither party is liable for a failure or delay in performance caused by an event beyond its reasonable control. Such events include acts of God, fire, flood, severe weather, earthquake, pandemic, epidemic, public health emergency, war, terrorism, civil unrest, government action, embargo, sanctions, labor dispute, carrier network failure, postal service disruption, power outage, internet outage and cyberattack.

The affected party will notify the other as soon as practical and will resume performance once the event ends. Where a force majeure event prevents us from providing the Services for more than 60 consecutive days, either party is entitled to terminate the subscription and we will refund the unused prepaid portion of your term.

Governing law and jurisdiction

20.1 Governing law

This agreement is governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20.2 Venue

Subject to the arbitration provision in Section 21, any action permitted to proceed in court will be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts. You consent to the personal jurisdiction of those courts and waive any objection based on venue or forum.

20.3 Language

This agreement is written in English. Any translation is provided for convenience. The English version controls in the event of a discrepancy.

Dispute resolution and arbitration

Mandatory arbitration

By using the Services you agree to resolve disputes through binding individual arbitration rather than in court. This section limits your legal rights, including your right to a jury trial and your right to participate in a class action. Section 21.7 explains how to opt out.

21.1 Informal resolution first

Before starting arbitration, send us written notice of your dispute describing the issue and the relief you want. We will do the same. Both parties agree to work toward a resolution for 60 days from the date of that notice. Most issues are settled at this stage.

21.2 Agreement to arbitrate

Any dispute arising out of or relating to this agreement, the Services or our relationship, which the parties do not resolve informally, will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

21.3 Arbitration procedure

Arbitration takes place in Middlesex County, Massachusetts, or by video conference or documents only where the AAA rules allow it. One arbitrator decides the matter. The arbitrator's award is final and binding, and a court of competent jurisdiction is entitled to enter judgment on it.

21.4 Individual arbitration only

YOU AND THE COMPANY AGREE TO ARBITRATE DISPUTES ONLY ON AN INDIVIDUAL BASIS. CLASS ACTIONS, CLASS ARBITRATIONS, PRIVATE ATTORNEY GENERAL ACTIONS AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED. IF THIS WAIVER IS FOUND UNENFORCEABLE, THE ENTIRE ARBITRATION AGREEMENT IN THIS SECTION IS VOID.

21.5 Exceptions

Either party is free to bring an individual claim in small claims court where the claim qualifies. Either party is also free to seek injunctive relief in court to protect intellectual property rights or to stop unauthorized use of the Services.

21.6 Fees

The AAA Consumer Arbitration Rules govern the allocation of filing and arbitrator fees. Where those rules place a fee on you that exceeds the cost of filing in court, we will pay the difference on your written request.

21.7 Your right to opt out

30 day opt-out window

Opt out of arbitration by sending written notice within 30 days of your account creation through our contact page with "Arbitration Opt-Out" in the subject line, or by mail to Biz International Corp., Legal Department, 1215 Main St, Unit 115, Tewksbury, MA 01876, USA. Include your full name, your account email, your mailing address and a clear statement declining arbitration. Opting out does not affect any other part of this agreement and it does not affect your service.

General provisions

22.1 Entire agreement

This agreement, together with the Privacy Policy, the Refund and Returns Policy and the plan details published on our pricing page, forms the entire agreement between you and us. It replaces all prior understandings on this subject.

22.2 Changes to these terms

We reserve the right to update this agreement. Material changes take effect 30 days after we post the revised version and update the "last updated" date at the top of this page. We will notify active subscribers by email of material changes. Continuing to use the Services after the effective date is your acceptance of the revised terms.

22.3 Severability

If any provision is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary and the remaining provisions stay in full force.

22.4 No waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

22.5 Assignment

You are not permitted to assign or transfer your rights under this agreement without our written consent. We are entitled to assign this agreement in connection with a merger, acquisition or sale of assets.

22.6 No agency

Nothing in this agreement creates a partnership, joint venture, employment or agency relationship between you and us, other than the limited mail-receiving agency established by your USPS Form 1583.

22.7 Notices
